THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Notice applies to protected health information (“PHI”) created or received in connection with your care coordinated through the Baripex platform. The independent healthcare providers who treat you are responsible for their own PHI practices; this Notice describes the practices followed on the platform and, where applicable, by Medex Clinic LLC acting as a business associate.
Our commitment
We are committed to protecting your PHI. We are required by law to maintain the privacy of PHI, to provide you this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect.
How we may use and disclose your PHI
For treatment
We may use and disclose your PHI to licensed providers and pharmacies to evaluate you, prescribe medication when appropriate, coordinate care, and fulfill and ship your treatment.
For payment
We may use and disclose limited information to obtain payment for services. To protect your privacy, clinical details are not shared with our payment processor.
For health care operations
We may use PHI for quality improvement, care coordination, and administrative functions necessary to run the platform.
As required or permitted by law
We may use or disclose PHI when required by law; for public health and safety activities; for health oversight; in judicial or administrative proceedings; to law enforcement as permitted; and to avert a serious threat to health or safety.
Uses and disclosures that require your authorization
Most uses and disclosures not described in this Notice — including most marketing, the sale of PHI, and disclosure of psychotherapy notes — will be made only with your written authorization, which you may revoke at any time.
Your rights regarding your PHI
- Right to access: You may inspect and obtain a copy of your PHI.
- Right to amend: You may request corrections to your PHI.
- Right to an accounting of disclosures: You may request a list of certain disclosures we have made.
- Right to request restrictions: You may request limits on how we use or disclose your PHI.
- Right to confidential communications: You may ask us to contact you in a specific way or at a specific location.
- Right to a paper copy: You may request a paper copy of this Notice at any time.
- Right to be notified of a breach: We will notify you if a breach compromises the privacy or security of your PHI.
Our responsibilities
- We are required to maintain the privacy and security of your PHI.
- We will let you know promptly if a breach occurs that may have compromised your PHI.
- We must follow the duties and privacy practices described in this Notice.
Changes to this Notice
We may change this Notice and make the new terms effective for all PHI we maintain. We will post the revised Notice on our website with a new effective date.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us at support@baripex.com or with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
